All photos purchased via the stock gallery are licensed such that they can be used for any illustrative purpose, even in a professional context, without geographical restrictions. Photos you purchase have however certain restrictions in place.

When you add the photo to your cart you have an option to choose the Size & Duration. The following options are available:

Size:

• Low Resolution
• High Resolution

Duration:

• 1 year license
• 3 years license
• 5 years license
• Perpetual license

Subject to the restrictions below the rights granted to you are:

• Non-exclusive, meaning that you do not have exclusive rights to use the content. We can license the same content to other customers.
• Unlimited, meaning you can use the content in an unlimited number of projects and in any media.

Depending on the option selected during the checkout, the rights granted to you are either:

• Perpetual – meaning that the license has no expiration or end date on your rights to use the content

or

• Limited to one, three or five years – meaning that the license has expiration of one, three or five years on your rights to use the content (from the date of purchase when a download link was made available to you).

Further Restrictions

All photos purchased through our website come with the standard license unless arranged otherwise. While this license allows you to use your photo in many ways, there are certain restrictions on the usage of the purchased photos.

• Unless arranged otherwise, usage of the low resolution photos downloaded via the Bronze, Silver, Gold or Platinum subscriptions are limited to social networks only.
• No Unlawful Use. You may not use content in a pornographic, defamatory or other unlawful manner.
• Publications including but not limited to context of alcohol, drugs, illness, sexuality or political matters need individual clearance.
• No Commercial Use of “Editorial Use Only” Content. You may not use content marked “editorial use only” for any commercial, promotional, advertorial, endorsement, advertising or merchandising purpose. This type of content is not model or property released and is intended to be used only in connection with events that are newsworthy or of general interest (for example, in a blog, textbook, newspaper or magazine article).
• No Standalone File Use. You may not use content in any way that allows others to download, extract, or redistribute content as a standalone file (meaning just the content file itself, separate from the project or end use).
• No Use in Trademark or Logo. You may not use content as part of a trademark, design mark, trade name, business name, service mark, or logo.
• No Subscription Abuse. You may not stockpile, download or otherwise store content not used in a project or end use within 30 days after the end of your subscription for future use.
• No False Representation of Authorship. You may not falsely represent that you are the original creator of a work that is made up largely of licensed content. For instance, you cannot create a painting based solely licensed content and claim that you are the author.
• No Products for Resale. Unless you purchase an extended license, you may not use content in connection with any goods or services intended for resale or distribution where the primary value lies in the content itself including, without limitation, cards, stationery items, paper products, calendars, apparel items, posters (printed on paper, canvas, or any other media), DVDs, mobile applications or other items for resale, license or other distribution for profit. This includes “on demand” products (meaning products in which content is selected by a third party for customization on such product on a made-to-order basis), including, without limitation, postcards, mugs, t-shirts, posters and other items.

The following usage is restricted unless you purchase an extended license.

Electronic Templates

Unless you purchase an extended license, you may not use content in electronic or digital templates intended for resale or other distribution (for example, website templates, business card templates, electronic greeting card templates, brochure design templates).

Limited print run.

Unless you purchase an extended license, you may not reproduce the content more than 500,000 times in physical print form. This restriction does not apply to electronic reproduction.

The rights granted to you are non-transferable and non-sublicensable, meaning that you cannot transfer or sublicense them to anyone else. There are two exceptions:

• Employer or client. If you are purchasing on behalf of your employer or client, then your employer or client can use the content. In that case, you represent and warrant that you have full legal authority to bind your employer or client to the terms of this agreement. If you do not have that authority, then your employer or client may not use the content.
• Subcontractors. You may allow subcontractors (for example, your printer or mailing house) or distributors to use content in any production or distribution process related to your final project or end use. These subcontractors and distributors may not use the content for any other purpose.

All of the licensed content is owned by Kamil Sustiak Adventure Photography. All rights not expressly granted in this agreement are reserved by KSA Photography and the content suppliers.

You do not need to include a photo credit for commercial use, but if you are using content for editorial purposes or social networks, you must include the following credit adjacent to the content or in visual production credits:

By subscribing to one of our plans you will be granted access to download unlimited amount of low resolution photos for your social network marketing. This subscription will be valid for a year.

You will also receive a coupon with a store credit which will allow you to download high resolution photos for free. The amount of the store credit assigned to you depends on the plan you choose. Please see the table below for more details about the available plans, number of photos you can download for free and store credits.

You can save substantial amount of money by signing up for one of the yearly plans but all photos can be also purchased individually, either as low or high resolution files. It really depends on your needs. Please see the pricing section on the INTRO & PRICING page for more details.

By purchasing a yearly subscription you automatically get unlimited access to download any low resolution photos in the stock gallery. Plus you will also save substantial amount of money if you plan to purchase multiple high resolution photos.

When you purchase one of the yearly subscription plans, an account will be created for you. You can access your account by clicking on the “MY ACCOUNT” link under the Stock Gallery menu or just follow this link.

Once you are logged in you will gain access to downloading the photos for free. The process is slightly different for low and high resolution photos:

Low-res photos

The price of low-res photos will be changed to zero once you are logged in. Just add them to your cart and proceed to the checkout as per usual. There is no credit card required any more if you only added low-res photos to your cart.

High-res photos

If you have purchased one of the Silver, Gold or Platinum plans, you are eligible to download a certain amount of high-res photos for free (depending on your plan). When you purchased your subscription plan a coupon was automatically assigned to your account which allows you to download high-res photos for free (up to the value of the coupon).

To download high-res photos, add them to your cart as usually and apply the coupon during the checkout process. This will discount the final price to zero.

Please note that the price for the high-res photos will stay unchanged on the product page as opposed to the low-res photo option.

You need be logged in to your account to be able to download your photos. You can log in and access your account by clicking on the “MY ACCOUNT” link under the Stock Gallery menu or follow this link.

No. We do not store your credit card. Your subscription is valid for one year since the purchase date. It is totally up to you whether you decide to continue using this service or not. We will do our best to make that decision easy for you ;-).

We understand a year is a long time and circumstances change. If you changed your mind, please get in touch with us. We cannot guarantee a full refund all the time as it depends on the number of photos you have used and the time since the purchase, but we are happy to help finding a solution which will work for you.

All photos available for download are in JPEG format (Color Space: sRGB). If the JPEG format or sRGB color space is not an option for you please get in touch with us.

All photos are available for download as low or high resolution files.

Low Resolution Files:

• files size limited to 1250px, 72dpi
  
• suitable for social media campaigns or small web images

High Resolution Files:

• largest available size – at least 5250px, 300dpi
  
• suitable for any digital or printed use

The size of the low resolution files is limited to 1255 x 837px / 72dpi / 3MB. What this mean is that the low-res photos are most suitable to be displayed as digital products (either as small pictures on the web or social media networks).

They are not ideal for printing large however the prints should look OK when printed to sizes up to A6 ~ 105 x 148 mm ~ 4.1 x 5.8 inches. If you require quality photos printed any larger than that, you may need to use the high-res option.
